2. General conditions of use of the site and the services offered

Use of the site implies full acceptance of the general conditions of use described below. These conditions of use are liable to be modified or supplemented at any time, so users of the site are invited to consult them on a regular basis.

This site is normally accessible to users at all times. LES VIGNERONS UNI-MEDOC may, however, decide to suspend access to carry out technical maintenance, in which case they will endeavour to give advance notice to users of the dates and times of maintenance.

The site is regularly updated by Mr Laurent VACHE. Likewise, the legal notices may be modified at any time: they nevertheless apply to users, who are invited to refer to them as often as possible in order to become familiar with them.

3. Description of the services provided.

The purpose of the site is to provide information on all the company’s activities and products.

LES VIGNERONS UNI-MEDOC make every effort to ensure that the information provided on the site is as accurate as possible. However, it cannot be held liable for omissions, inaccuracies or failures to update, whether by itself or by third-party partners who provide it with this information.

All information on the site is given for illustrative purposes and is liable to change. Furthermore, the information on the site is not exhaustive. It is provided subject to any changes taking place after being put on line.

4. Contractual limitations on technical data.

The site uses JavaScript technology.

The website cannot be held liable for material damage related to use of the site. In addition, users undertake to access the site using recent equipment that is free from viruses and with an up-to-date browser.

5. Intellectual property and infringements.

LES VIGNERONS UNI-MEDOC owns the intellectual property rights or holds the rights to use all content accessible on the site, in particular the texts, images, graphics, logos, icons, sounds and software.

Any reproduction, representation, modification, publication, or adaptation of all or part of the site content, whatever the means or process used, is prohibited without the prior written authorisation of LES VIGNERONS UNI-MEDOC.

Any unauthorised use of the site or any of its content will be considered as constituting an infringement and prosecuted in accordance with the provisions of Articles L.335-2 et seq. of the Intellectual Property Code.

6. Limited liability.

LES VIGNERONS UNI-MEDOC cannot be held liable for any direct or indirect damage caused to the user’s equipment when accessing the site and resulting either from the use of equipment not meeting the specifications in point 4 or from the appearance of a bug or incompatibility.

Similarly, LES VIGNERONS UNI-MEDOC cannot be held liable for indirect damage (such as loss of business or loss of opportunity) resulting from the use of the site.

Interactive areas are available to users. LES VIGNERONS UNI-MEDOC reserve the right to remove without prior notice any content posted in these areas that violates laws applicable in France, in particular the provisions relating to data protection. Where applicable, LES VIGNERONS UNI-MEDOC also reserves the right to invoke the user’s civil and/or criminal liability, in particular in the event of racist, offensive, defamatory or pornographic messages, regardless of the medium used (text, photograph, etc.).

7. Personal data management.

In France, personal data is protected in particular by law no. 78-87 of 6 January 1978, law no. 2004-801 of 6 August 2004, article L. 226-13 of the Penal Code and the European Directive of 24 October 1995.

When using the site, data may be collected: the URLs of links used to access, the user’s Internet access provider, the user’s Internet Protocol (IP) address.

In all cases, LES VIGNERONS UNI-MEDOC only collects personal information about the user for the needs of certain services offered by the site. Users provide this information with full knowledge of the facts, particularly when entering it themselves. In this case, users of the site are informed whether or not it is obligatory to provide this information.

In accordance with the provisions of Articles 38 et seq. of law 78-17 of 6 January 1978 on data processing, files and freedoms, all users have the right to access, correct and object to the use of their personal data by making a written and signed request accompanied by a copy of their identity document with the signature of the document holder, specifying the address to which the reply should be sent.

No personal information about a user of the site is published without the user’s knowledge, or exchanged, transferred, assigned, or sold to third parties on any medium whatsoever. Only in the event of a take-over of LES VIGNERONS UNI-MEDOC and its rights would such information be passed on to a prospective purchaser, who would in turn be bound by the same obligation to store and modify data in relation to users of the site.

The site is not declared to the French data protection authority (CNIL) in accordance with the GDPR law of 25 May 2018.

The databases are protected by the provisions of the law of 1 July 1998 transposing directive 96/9 of 11 March 1996 on the legal protection of databases.

8. Applicable law and attribution of jurisdiction.

Any dispute in connection with the use of the site is subject to French law. Exclusive jurisdiction is attributed to the relevant courts.
